Clear rules for a calmer park day

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Rope Drop Hero, including our website, mobile applications, and related services (the "Service"). By using the Service, you agree to these Terms.

Rope Drop Hero, LLC ("Company," "we," "us," or "our") reserves the right to modify these Terms at any time. Material changes will be communicated via the App or by email. Your continued use of the App following such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

Parents or guardians may create accounts on behalf of their families to use the trip planning and coordination features. By creating an account, you represent and warrant that all information you provide is accurate, complete, and truthful.

3. Your Account

You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must notify us promptly of any unauthorized use.

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal iOS device solely for your personal, non-commercial use. The App is licensed, not sold.

4. Subscriptions & Billing

4.1 Subscription Tiers

• Free: Live wait times, Lightning Lane browsing, 7-day crowd calendar, restaurant browsing, and one Quest
• Adventurer ($9.99/month or $79.99/year): Unlimited Quests, advanced crowd prediction, dining alerts, early dining reservation access, and Party Beacons live party location sharing
• Hero ($29.99/month or $239.99/year): All Adventurer features plus Lightning Lane auto-booking, dining auto-booking, priority customer support, and unlimited customized itineraries. Includes a 7-day free trial for new Hero subscribers.
• Starlight Concierge ($49.99/month or $399.99/year): All Hero features plus AI-powered Morning Briefings, Evening Recaps, Live Trip Copilot, Post-Trip Analytics, and dedicated concierge-style support

4.2 Auto-Renewal and Billing

Subscriptions are auto-renewing on a monthly or annual basis, as selected at purchase. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Billing occurs through the Apple App Store via StoreKit. You will be charged the subscription price applicable at the time of renewal.

Billing inquiries and refund requests are handled by Apple in accordance with App Store policies. We do not process refunds directly.

4.3 Free Trial

New Hero tier subscribers may be eligible for a 7-day free trial. The free trial is non-refundable, and you will be charged the full Hero subscription price after the trial period expires unless you cancel before the trial ends.

4.4 No Family Plans

The App does not support iOS Family Sharing or group purchase plans. Each individual user must maintain their own account and subscription.

4.5 Price Changes

We reserve the right to change subscription prices. We will notify you at least 30 days in advance of any price increases. If you do not agree to the new price, you may cancel your subscription before the change takes effect.

5. Use of the Service

The Service is designed to help you plan your visit. You agree to use the Service in compliance with park rules, applicable laws, and these Terms.

• Do not use the App to harass, threaten, defame, or abuse other users or anyone else.
• Do not interfere with the operation of the App or its servers.
• Do not attempt to gain unauthorized access to the App, its servers, or user accounts.
• Do not scrape, spider, or automate the collection of data from the App without authorization.

6. Intellectual Property

The App and all content within it, including text, graphics, logos, source code, object code, algorithms, and software, are the exclusive property of Rope Drop Hero, LLC or its licensors. All intellectual property rights are reserved.

You retain all rights to any user-generated content you create within the App. By submitting such content, you grant the Company a non-exclusive, worldwide, royalty-free license to use it for purposes of providing and improving the App.

7. Disclaimers and Limitation of Liability

The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or timeliness of wait time data, crowd predictions, Lightning Lane availability, dining reservations, park hours, show schedules, or other information provided by the App.

To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and successors from claims, damages, liabilities, costs, and expenses arising from your violation of these Terms, violation of applicable law, unlawful use of the App, or user-generated content you submit.

9. Termination

You may terminate your account and subscription at any time through the App settings or iOS Settings. The Company may suspend or terminate your account immediately, without notice, if you violate these Terms, engage in unlawful or harmful conduct, abuse the App's features or systems, or fail to comply with company policies.

10. Payment Authorization

By purchasing a subscription, you authorize Apple to charge your designated payment method for the subscription price and any applicable taxes. You are responsible for maintaining accurate payment information in your App Store account.

11. Third-Party Services

The App integrates with and relies on third-party services including Apple WeatherKit, OpenAI, Supabase, and Walt Disney World park data sources. These services are provided by third parties and subject to their own terms and conditions.

Disney Friends & Family Delegation

The App may use Disney's Friends & Family authorization system to access permissions for Lightning Lanes, dining reservations, and itinerary management. You maintain control over what permissions you grant and can revoke access anytime through Disney's system. We do not store your Disney passwords.

12. iOS-Only Platform

Rope Drop Hero is available exclusively on iOS via the Apple App Store. By using the App, you acknowledge that you own or have permission to use an iOS device and accept Apple's App Store terms and conditions.

13. Data Privacy and Security

Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data. The Privacy Policy is incorporated by reference into these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, USA, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Illinois for disputes arising from these Terms or your use of the App.

15. Dispute Resolution

In the event of a dispute, you agree to first attempt informal resolution by contacting us at legal@ropedrophero.com. If informal resolution is not successful, you may pursue legal action in accordance with Section 14 above.
